Buying a car is a big decision, owing in part to its financial implications. With an array of financing options available to customers, and incentive structures between lenders and brokers, motor finance has significant regulatory interaction.

The FCA has recently proposed changes to how finance brokers are remunerated, criticising commission models and supporting improved disclosure to customers which have been pushed back only a few months due to the CV19 crisis. These conduct issues are subject to even greater scrutiny following the introduction of the Senior Managers & Certification Regime. Regulatory intervention is now high in an industry unaccustomed to FCA presence.

Compliance specialists at Konexo, a division of Eversheds Sutherland, co-presented two webinars with Arena Group now available ON DEMAND to help your business understand significant recent and upcoming regulatory change in the motor finance industry, how to manage regulatory response, and key impact on governance in your dealership.

Part I recorded on 31st March covered the origins of FCA Consultation Paper CP19/28 and its proposed industry changes, including:

  • Changes to commissions, disclosures and expected timeframe
  • The FCA’s regulatory agenda for the motor finance industry
  • The importance of treating customers fairly
  • Impact on affordability and lending culture
  • Accounting for vulnerable customers

Part II recorded on 30th April 2020 built on the first part of the series by exploring how to avoid business arrangements giving rise to conflicts of interest and how to oversee the process.

  • Recap of key incoming changes
  • The FCA’s expectations on conflicts of interest
  • Key impact on firm governance and oversight
  • Tie-in with the Senior Managers and Certification Regime
  • Managing regulatory response
  • Developing a robust compliance programme
